1. Provider and licence

Penombra by Systema360 is provided by Systema360 S.r.l., 85100 Potenza (PZ), VAT or tax code 02227730765, contacts info@systema360.it and certified address systema360@pec.it. Systema360 is the provider of the app and is responsible for the app itself and for its support.

The licence to install and use Penombra is governed by Apple's standard EULA, which applies when you download the app from the App Store. This page does not replace it and does not modify it, it only adds what concerns this product, and in case of conflict Apple's licence prevails.

2. What the app does

Penombra lowers the perceived brightness of your displays by laying a dark veil over the content, and it keeps the Mac from sleeping while a preset is on. The veil is an application window: it does not change hardware brightness, it does not touch colour calibration and it installs no drivers.

3. What the app does not do, by choice

The app uses no private APIs, does not talk to monitors over DDC, does not alter the system gamma tables and does not request the Accessibility permission. If the app quits, for any reason, the veil quits with it and the screen returns immediately to the system brightness. This is a structural guarantee, not a promise of behaviour.

4. Informed use

A very dark veil makes the screen hard to read, and that is what it is meant to do. An emergency shortcut that restores full light is always available, and it works without Penombra Pro. Wakefulness keeps the Mac from sleeping and therefore uses more battery: this is why there is a threshold below which wakefulness switches off on its own. You choose that threshold and you decide when to use the app.

5. Free tier and Penombra Pro

The app is usable without paying. The veil, wakefulness, the three evening presets, the gradual transition and the safeguards are included. Penombra Pro is a one time unlock that opens your own presets, their editing, keyboard shortcuts, schedules, automation rules, sequences and external channels. It is not a subscription and it does not renew.

6. Price, purchase and refunds

The price of Penombra Pro is the one shown by the store at the time of purchase. The purchase goes through Apple, which for the App Store is the seller and issues the receipt, while the provider of the app remains Systema360. Withdrawal and refund requests are submitted to Apple under its terms of sale.

Apple's standard licence further provides that, if the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever, and any other claim relating to the app is a matter for Systema360.

If a purchase is refunded the Pro functions close again, while switching off an active preset always remains possible, so nobody is left with a dark screen.

7. Statutory guarantee of conformity

If you are a consumer you benefit from the statutory guarantee of conformity provided by the Italian Consumer Code for digital content and services. That guarantee stands and is not limited by these terms.

8. Intellectual property, proper use, maintenance and availability

The app, its name, brand and graphics remain the property of Systema360 S.r.l.. Decompiling, modifying or redistributing the app is not permitted except within the mandatory limits of the law. We may update, change or discontinue features, and we may temporarily suspend availability for maintenance.

9. Liability

Penombra adjusts screen light and Mac wakefulness, and it is not a safety device: it should not be used where a change in brightness or a machine staying awake can have serious consequences. The app is provided as is.

If you are a consumer, every protection the law grants you stands, and nothing in these terms excludes or limits it.

If you use the app for professional purposes, to the extent permitted by law we are not liable for indirect or consequential damages, including loss of data, work or profit, and our total liability is limited to the greater of fifty euro and what you paid for Penombra Pro in the preceding twelve months. Wilful misconduct, gross negligence and any other liability the law does not allow to be limited stay outside this cap.

10. Termination and uninstalling

You can stop using Penombra at any time. Deleting it from the Mac also removes presets and preferences, because they live only there. Penombra Pro is a one time purchase and does not renew, so there is no subscription to cancel, and the unlock stays tied to your Apple Account: if you reinstall the app you get it back with Restore purchases.

11. Changes to these terms

We may update these terms for legal compliance, security, changes required by Apple, corrections or product evolution. The effective date at the top of this page says when they last changed.

12. Governing law and venue

Italian law applies. For consumers the court of their place of residence or elected domicile remains competent, as provided by the Italian Consumer Code. For other users the court of Potenza is competent.

13. Dispute resolution

For any problem you can write to info@systema360.it, and we try to solve it there. If you are a consumer you may also use the alternative dispute resolution procedures provided by law.
